Terms & Conditions
The following terms and conditions apply to all clients of Jamie Alexander Personal Training & Coaching.
Your Obligations
1. You are required to wear appropriate clothing and footwear when working out.
2. Your trainer may require a letter of ‘medical clearance’ from my GP if you answer ‘Yes’ to any questions on the PARQ. You are aware that your GP may charge for providing this letter.
3. You understand and agree that it is your responsibility to inform your trainer of any conditions or changes to your health, now and on-going, which might affect your ability to exercise safely and with minimal risk of injury.
4. You understand that your results are linked to your ability to follow advice in and outside of the gym.
5. If your trainer requires further medical information from a practitioner, you must provide such details.
6. You understand the risks in participating in a programme of strenuous exercise. If you sustain or claim to sustain any accidental injury, illness or death while participating in training, you acknowledge that your trainer is not responsible, and cannot be held liable.
For Customers Paying By Direct Debit
The following terms and conditions apply to all customers paying Jamie Alexander Personal Training & Coaching via Direct Debit.
Principle Terms
1. All payments will be collected on the 1st of the month, in advance, every month, until cancelled by either you (the client), or Jamie Alexander (the trainer), in writing with the required notice.
2. All direct debit plans require a minimum commitment of three contractual months. That is one payment on the 1st of the month, three months in a row. Thereafter the direct debit can be cancelled at any time with the required notice.
3. If a client wishes to cancel their direct debit, 30 full day’s notice must be given to Jamie Alexander Personal Training & Coaching in writing. If 30 full day’s notice is not given to Jamie Alexander Personal Training & Coaching in writing, before the next payment is due, that is the 1st of the month, then this payment will still be payable on the 1st of the month and the direct debit will end the following month. If you (the client) cancel your direct debit without giving the required notice, then Jamie Alexander will contact you to ensure the next and final payment is made on time. If you fail to make this payment as bound by these terms and conditions, Jamie Alexander may take further legal action if required.
4. You have the right to cancel this direct debit at any time, providing you have completed your minimum 3-month term and have provided 30 full day’s notice in writing.
5. This agreement is non-transferable.
6. If you are attending in-person sessions, depending on which direct debit plan you are on, for example, if you are on the 8 sessions a month plan, 8 sessions per month must be completed. If for whatever reason, we are unable to complete 8 sessions one month, then both you and Jamie Alexander will do everything possible to fit it in amongst a new set of 8 sessions the following month until we have caught up all remaining sessions. Your direct debit will continue as normal. This applies to all direct debit plans, regardless of session numbers.
7. In the event that we enter a national lockdown and the gym is forced to close, due to COVID or any other pandemic, sessions will continue as normal outdoors within travelling distance of the gym, at the discretion of Jamie Alexander, as long as national guidance allows this.
Fees and charges
8. The only fee or charge you will be liable to pay is your monthly payment via direct debit which you agree and sign to before money is taken from your account. There will be no other hidden fees or charges.
9. In the event that your plan expires or there is a price increase in your plan, Jamie Alexander will provide you with 30 day’s notice. You have no obligation to continue if you do not accept these changes. Your price or plan will not change in your initial 3-month contract period.
10. If you are attending in-person sessions, when we reach a 5-week month, if you wish to do more sessions, in order not to miss any week’s training, then single top-up sessions can be purchased at the same rate of the plan that you are already on. This can be done by Bank Transfer or cash payments.
11. If you are attending in-person sessions, if you purchase sessions separately to your Direct Debit plan before it is due to start on the 1st of the following month, and you have purchased these sessions at the same rate as your Direct Debit plan for, e.g. £50 per session because you are on the 8 session Direct Debit plan, then your cooling off period will end the day you have your very first session.
Cancelling Sessions
12. If Jamie Alexander needs to cancel your direct debit contract before all paid sessions are complete, you will receive a full refund on any remaining sessions in your plan for that month and no further payments will be taken.
13. If you cancel a session with less than 24 hour’s notice, the session will stand and that session will come off of your session total for that month. The same applies if you fail to turn up to a session and Jamie will not be required to reschedule your session. This term is without exception.
14. If Jamie Alexander cancels a session with you, with less than 24 hour’s notice, you will be given a complimentary session to be used in line with your monthly total as soon as is practicably possible.
Fair Early Contract Cancellation
15. Long term (over 3 months) illness or injury – This agreement may be cancelled in the event of an illness, injury or medical condition, which in the opinion of a suitably qualified medical practitioner, prohibits any exercise for 3 months or longer, in writing. You must inform Jamie Alexander as soon as practicably possible that you are unable to continue with your training. Once this written confirmation has been provided, you will receive a refund on any remaining uncompleted sessions and your 3-month contract will become null and void. If Jamie Alexander does not receive a GP letter within 30 days of you informing him, then your remaining sessions will stand, you will not receive a refund and you must still complete your 3-month contract when you are able to. If you cancel your direct debit without providing a satisfactory GP letter, then Jamie Alexander will contact you to ensure payment is made on time for the remainder of your contract. If you fail to do this, Jamie Alexander may take further legal action if deemed necessary.
16. You have a 14-day cooling off period upon signing the direct debit mandate. If you sign up to your direct debit plan with less than 14 days before your first session, this cooling off period will end exactly 24 hours before you have your first session booked in.
Further Information
17. Direct debits payments will appear on your bank statement as GOCARDLESS.
For Customers Paying By Bank Transfer/Cash or Buying Packs
The following terms and conditions apply to all customers of Jamie Alexander Personal Training & Coaching paying by bank transfer/cash or buying packs.
Principle Terms
1. All payments are due before the session begins. If your initial block of sessions booked ends and you purchase more sessions, this next payment is due before the next payable session begins.
2. This agreement is non-transferable.
3. In the event that the gym is forced to close for any reason, including COVID, a national lockdown or any other pandemic, sessions will continue as normal outdoors within reasonable travelling distance of the gym, at the discretion of Jamie Alexander. In the event of a national lockdown, this will stand as long as national guidance allows this.
4. If you are doing 2 sessions per week and you can only do one session one week, this session must then try to be used in line with 2 the following week, meaning you would do 3 sessions the following week. This is the same regardless of the session frequency agreed.
Fees and charges
5. In the event that your there is a price increase in your sessions, you will be given 30 day’s notice. You have no obligation to continue if you do not accept these changes.
Cancelling Sessions
6. Jamie Alexander has the right to terminate this agreement at any time without notice. In the unlikely event that this does happen, you will receive a full refund on any remaining sessions and no further payments will be taken.
7. If you cancel a session with less than 24 hour’s notice, the session will stand and that session will come off of your session total for that month. The same applies if you fail to turn up to a session and Jamie will not be required to reschedule your session. This term is without exception.
8. If Jamie Alexander cancels a session with you, with less than 24 hour’s notice, you will be given a complimentary session to be used in line with your other sessions (e.g. if you do one session per week, you will receive another complimentary session and do two another week), as soon as is practicably possible.
Fair Early Contract Cancellation
9. In the event of long-term illness or injury lasting over 3 months, you may cancel this agreement by providing written notification to info@jamiealexander.co.uk. Upon receipt, you have 30 days to supply a satisfactory GP letter supporting your condition. Upon verification, any remaining uncompleted sessions will be refunded, and the contract will be terminated. Failure to provide a satisfactory GP letter within 30 days will result in no refund, and your remaining sessions must still be fulfilled when able.
10. Once the terms & conditions have been signed there is a 14-day cooling off period. If you sign the T&Cs with less than 14 days before your first session is booked in, this cooling off period will end exactly 24 hours before your first session.
Client Misconduct
Inappropriate behaviour will not be tolerated. This includes but is not limited to any verbal or physical abuse as well as sexual advances, both in person, or via mobile phone, email or any other form of communication, including social media. If any client misconduct were to occur, either in an obvious or subtle way to Jamie or any other client, your session will end immediately, a refund will not be given for that session or any remaining sessions yet to complete and legal action may be taken if deemed necessary.
